In deze voorwaarden regelen we de zakelijke relatie tussen u en Koster Fine Art en zijn bedoeld om zowel bindend als eerlijk te zijn. De basis voor elke bestelling of overeenkomst zal daarom altijd de volgende Algemene Voorwaarden van Koster Fine Art zijn en u erkent en bevestigt dat u hiervan op de hoogte bent en akkoord gaat met de toepassing ervan wanneer u een bestelling bij ons plaatst. U kunt de algemene voorwaarden hier lezen.
Product
Het uiterlijk en de kleur van de foto's kunnen veranderen en vervagen. Om ervoor te zorgen dat u van onze kunstwerken kunt blijven genieten, mag u foto's, lamineringen of lijsten niet geheel of gedeeltelijk blootstellen aan direct zonlicht, direct boven verwarmingstoestellen hangen of blootstellen aan een hogere luchtvochtigheid dan verwacht in een normale woonkamer. Foto's, lamineringen en lijsten zijn niet geschikt voor buitenruimtes, kelders, badkamers of keukens. Lamineringen met UV-beschermfolie of acrylglas en houten frames zijn zeer gevoelig voor krassen en vuil en mogen daarom alleen met handschoenen of een gelijkwaardige bescherming worden gehanteerd.
Domein
De volgende Algemene Voorwaarden, in de meest actuele versie op het moment van bestelling, beheersen uitsluitend de zakelijke relatie tussen Koster Fine Art, Naarden, hier handelend onder de merknaam Koster Fine Art, en de besteller. Koster Fine Art zal door de besteller gestelde voorwaarden niet erkennen, tenzij deze voorwaarden uitdrukkelijk schriftelijk door Koster Fine Art zijn aanvaard.
Sluiten van de overeenkomst
De weergave van producten in de onlineshop vormt geen juridisch bindend aanbod; het is uitsluitend een niet-bindende online catalogus. De producten die u heeft geselecteerd door op de knop “Toevoegen aan winkelmandje” te drukken, worden aan het einde van het bestelproces nogmaals voor u samengevat in een besteloverzicht. Hier kunt u de verschillende tijdens het bestelproces verstrekte gegevens bekijken en deze aanvullen of corrigeren door op de knop “Wijzigen” te klikken. Door op de knop “Nu kopen” te klikken, verzendt u uw bestelgegevens en verklaart u bindend aan Koster Fine Art dat u de daar genoemde producten (Aanbieding) wilt kopen. Wij accepteren uw bod automatisch na ontvangst van uw bestelling. Direct na het verzenden van de bestelling ontvangt u een e-mail met een bestel- en contractbevestiging, waarin de gegevens van uw bestelling nogmaals vermeld staan.
De tekst van uw bestelling wordt door ons opgeslagen en kan op verzoek na voltooiing van uw bestelling naar u worden verzonden. Voor uw eigen bescherming adviseert Koster Fine Art de bestelgegevens en de op het moment van bestelling geldende Voorwaarden uit te printen. De contracttaal is Engels.
Houd er rekening mee dat we alle producten alleen in kleine hoeveelheden verkopen.
Annulering
Houd er rekening mee dat kunstwerken met aangepaste montage/ingelijsting en ongemonteerde/ingelijste fotoafdrukken zijn uitgesloten van het recht op annulering/herroeping, omdat ze op maat worden geproduceerd volgens uw individuele specificaties. Op maat gemaakte producten worden beschouwd als definitieve verkoopartikelen en zijn uitgesloten van het herroepingsrecht volgens artikel 230p, lid f, nr. 1 van het Burgerlijk Wetboek, Boek 6. U heeft het volgende herroepingsrecht voor alle online bestellingen van geprefabriceerde werken, opgegeven door Koster Fine Art. Wettelijk herroepingsrecht & voorbeeldformulier voor herroeping:
Herroepingsrecht
U heeft het recht om dit contract binnen 14 dagen zonder opgave van redenen te herroepen. De annuleringsvoorwaarden gelden 14 dagen vanaf:
De dag waarop u – of een door u genoemde derde partij die niet de verzenddienst is – de goederen in bezit neemt, als u in één bestelling één artikel of meerdere artikelen heeft besteld en het artikel(en) arriveert in één levering

Om uw herroepingsrecht uit te oefenen, dient u ons hiervan op de hoogte te stellen Koster Fine Art, Meentweg 12, 1411GS Naarden. e-mail: info@kosterfineart.com in een duidelijke, schriftelijke verklaring (bijvoorbeeld per brief of e-mail).
Aan de termijn voor het herroepingsrecht wordt voldaan zolang uw verklaring waaruit blijkt dat u gebruik maakt van het herroepingsrecht binnen de gestelde herroepingstermijn wordt verzonden.
Annuleringsvoorwaarden en -proces
Als u het koopcontract herroept, moeten wij alle van u ontvangen betalingen, exclusief verzendkosten, onverwijld terugbetalen, uiterlijk binnen 30 dagen na ontvangst door ons van de verklaring waaruit uw herroeping blijkt. Terugbetalingen worden teruggestort op de oorspronkelijke betaalmethode, tenzij uitdrukkelijk anders is overeengekomen. Wij kunnen wachten met terugbetaling tot het moment dat wij de geretourneerde goederen hebben ontvangen of totdat u een bewijs heeft geleverd van de retourzending, afhankelijk van wat zich het eerst voordoet. U dient de goederen onverwijld in de originele verpakking terug te sturen. Ze moeten uiterlijk 30 dagen na de dag waarop u ons op de hoogte stelt van de herroeping, worden verzonden. Aan deze termijn wordt voldaan zolang de retourzending binnen de gestelde termijn van 30 dagen wordt verzonden.
U draagt de directe kosten voor het retourneren van uw bestelling. Goederen kunnen niet per gewone post worden geretourneerd.
U bent alleen verantwoordelijk voor waardevermindering van goederen als, na inspectie van hun staat, eigenschappen en functionaliteit, de waardevermindering terug te voeren is op uw onjuiste omgang met de goederen.
Levering
Tenzij anders overeengekomen vindt levering plaats af print of frameshop op uw adres of op het door u opgegeven afleveradres en omdat uw bestelling speciaal naar uw wensen wordt gemaakt, bedraagt de productie- en levertijd ca. 14 werkdagen. Accepteer geen verzending als het pakket gescheurd, gebogen of beschadigd lijkt.
Editiecertificaat met handtekening
Om organisatorische redenen kan Koster Fine Art de besteller het editiecertificaat met de handtekening van de kunstenaar en de editiegegevens ook afzonderlijk – en met vertraging – sturen. In dit geval gaat de herroepingstermijn pas in na ontvangst van het Editions-certificaat met handtekening. Als u gebruik maakt van uw herroepingsrecht, moet u ook het ongebruikte Editiecertificaat onmiddellijk retourneren. Zonder ontvangst van het editiecertificaat wordt de aankoopprijs niet terugbetaald. Het herroepingsrecht vervalt indien het Editiecertificaat op het kunstwerk, de lijst, de laminering of elders wordt gebruikt.
Prijzen, vervaldatum en betaling, standaard
De in de onlineshop genoemde prijzen zijn eindprijzen inclusief omzetbelasting. De verzendkosten zijn niet bij de prijs inbegrepen en worden er telkens bij opgeteld. Informatie over de verzendkosten vindt u in Hoofdstuk 7 van deze Algemene Voorwaarden.
De aankoopprijs wordt betaald via creditcard (Visa, Mastercard, American Express).
Indien er onvoldoende saldo op de rekening van de besteller staat, of de besteller de bankafschrijving zonder geldige reden ongedaan maakt, heeft Koster Fine Art het recht om van de besteller administratiekosten ter hoogte van € 10,00 te eisen.
Facturen dienen binnen 10 dagen na factuurdatum voldaan te zijn.
Als u in verzuim bent, behoudt Koster Fine Art zich het recht voor om consumenten vertragingsrente in rekening te brengen ter hoogte van 5 procentpunten boven de respectieve basisrente per jaar gepubliceerd door de Europese Centrale Bank en om bedrijven 9 procentpunten in rekening te brengen boven de respectieve basisrente per jaar gepubliceerd door de Europese Centrale Bank. Daarnaast kan Koster Fine Art een vast tarief van € 2,50 per herinnering in rekening brengen, met uitzondering van de eerste aanmaning. Indien als gevolg van deze betalingsachterstanden aantoonbaar hogere kosten worden gemaakt, behoudt Koster Fine Art zich het recht voor om terzake claims te doen gelden.
In bovenstaande gevallen heeft u het recht te bewijzen dat er daadwerkelijk geen kosten door Koster Fine Art zijn gemaakt of dat deze kosten lager zijn geweest dan de hierboven genoemde forfaitaire erelonen.
Verzendkosten
Voor verzendkosten binnen Nederland hanteerd Koster Fine Art Gallery de tarieven van Post NL.
Voor leveringen buiten Nederland maar binnen de EU hanteert Koster Fine Art de volgende verzendtarieven, inclusief onze veilige speciale verpakking en verzekering:
'Print only' afhankelijk van maat 50 cm. – 100 cm. € 25,00 - € 50,00
Plexiglas en ingelijste kunst afhankelijk van langste zijde 32 cm. – 100 cm. € 35,00 - € 75,00.
Voor grotere formaten zijn de verzendkosten altijd op aanvraag.
Voor leveringen buiten de EU zijn de verzendkosten altijd op aanvraag.
Bestellingen met artikelen van verschillende afmetingen worden verzonden tegen het tarief van de grootste afbeelding in de bestelling.
Compensatie, retentie
U heeft alleen recht op verrekening als uw tegenvorderingen juridisch gegrond zijn of door Koster Fine Art worden erkend. U heeft ook het recht op verrekening als u over gebreken reclameert of tegenvorderingen indient op grond van hetzelfde koopcontract. Bovendien bent u alleen bevoegd om het retentierecht uit te oefenen voor zover uw tegenvordering op dezelfde contractuele relatie berust.
Eigendomsvoorbehoud
Tot de volledige en definitieve betaling blijven de geleverde goederen eigendom van de kunstenaar of Koster Fine Art Gallery.
Betrouwbaarheid
Binnen het kader van de wettelijke bepalingen is zij onbeperkt aansprakelijk voor schadevergoeding.
Met betrekking tot verlies van leven, lichamelijk letsel of schade aan de gezondheid die het gevolg is van opzettelijk of nalatig plichtsverzuim of anderszins het gevolg is van opzettelijk of nalatig gedrag van Koster Fine Art.
Die het gevolg is van opzettelijk of nalatig plichtsverzuim of anderszins het gevolg is van opzettelijk of grof nalatig gedrag van de aanbieder.
De aansprakelijkheid van Koster Fine Art is beperkt tot de vergoeding van voorzienbaar verlies of schade die typisch is voor de overeenkomst, veroorzaakt door licht nalatige schending van materiële plichten door Koster Fine Art. Materiële plichten zijn plichten waarvan de vervulling een voorwaarde is voor een correcte uitvoering van de overeenkomst en op de naleving waarvan de besteller kan vertrouwen.
Op de aansprakelijkheid van Koster Fine Art ter zake van vergoeding van vergeefse kosten zijn bovenstaande bepalingen van overeenkomstige toepassing. De aansprakelijkheid op grond van de Productaansprakelijkheidswet blijft onaangetast.
Garantie
Tenzij uitdrukkelijk anders overeengekomen, gelden de wettelijke garantierechten. De wettelijke garantietermijn van één jaar is van toepassing. Dit begint bij de overdracht van de goederen. Gedurende deze periode worden alle gebreken die onder de wettelijke garantieverplichtingen vallen, gratis verholpen.
Indien tijdens de inspectie of daarna een gebrek wordt ontdekt, dienen wij hiervan direct op de hoogte te worden gesteld. Van direct belang is in dit geval dat u ons binnen twee weken op de hoogte stelt, waarbij het tijdig versturen van de melding voldoende is om de termijn te halen. Ongeacht deze inspectie- en reclamatieplicht dient u zichtbare gebreken (waaronder onjuiste of te korte leveringen) binnen twee weken na levering schriftelijk te melden, waarbij het tijdig versturen van de melding voldoende is om aan de termijn te voldoen. Indien u nalaat een behoorlijke inspectie uit te voeren en/of ons niet op de hoogte te stellen van het gebrek, is onze aansprakelijkheid voor het niet gemelde gebrek uitgesloten.
Geen verlening van rechten
Door een fotoafdruk te kopen, verkrijgt u alleen het materiële eigendom van de afdruk. Er worden geen andere rechten verleend of geïmpliceerd. Elke reproductie (kopiëren), verspreiding, verhuur, openbare tentoonstelling of ander analoog of digitaal gebruik is niet toegestaan, tenzij dit wettelijk is toegestaan. U kunt de afdruk echter doorverkopen.
Verzamelen, verwerken en gebruiken van persoonsgegevens
Alle bepalingen met betrekking tot de bescherming van uw gegevens vindt u in het privacybeleid van Koster Fine Art. Je kunt ze hier vinden.
Toepasselijk recht
Nederlands recht is van toepassing.

Our terms and conditions regulate the business relationship between you and Koster Fine Art and are intended to be both binding and fair. The basis for any order or contract will therefore always be the following General Terms and Conditions of Koster Fine Art and you acknowledge and confirm you are aware of them and agree to their application when you place an order with us. Product
The appearance and colour of the photographs can change and fade. To ensure you keep enjoying our works of art, you should not expose photographs, laminations or frames, either in part or in full, to direct sunlight, hang them directly above heating appliances or expose them to a higher level of humidity than expected in a normal living room. Photographs, laminations and frames are not suitable for external areas, cellars, bathrooms or kitchens. Laminations with UV protective film or acrylic glass and wooden frames are very sensitive to scratches and dirt and should therefore only be handled with gloves or equivalent protection.
Scope
The following General Terms and Conditions in their most current version at the time of order shall exclusively govern the business relationship between Koster Fine Art, Naarden, here acting under the brand Koster Fine Art, and the orderer. Koster Fine Art shall not recognise any terms set out by the orderer unless such conditions have been expressly agreed to by Koster Fine Art in writing.
Conclusion of contract
The display of products in the online shop does not constitute a legally binding offer; it is a non-binding online catalogue only. The products you have selected by pressing the “Add to basket” button are summarised again for you in an order overview at the end of the order process. Here you can review the various information provided during the order process and add to or correct it by clicking the “Change” button. By clicking the button “Buy now”, you send your order details and make a binding declaration to Koster Fine Art that you want to purchase the products listed there (Offer). We automatically accept your offer upon receipt of your order. Directly after sending the order, you will receive an email with an order and contract conformation, in which the details of your order are listed again.
The text of your order is saved by us and upon request can be sent to you after completion of your order. For your own protection, Koster Fine Art recommends printing out the order details and the General Terms and Conditions applicable at the time of order. The contractual language is English.
Please note that we sell all products in small quantities only.
Cancellation
Please note that artworks with custom mounting/framing as well as unmounted/unframed photo prints are excluded from the right to cancellation/withdrawal, as they are custom-produced to your individual specifications. Custom products are considered final sale items and are excluded from the right to cancel according to Article 230p, Paragraph f, No. 1 of the Burgerlijk Wetboek of the Netherlands, Boek 6. You have the following right of cancellation for all online orders of prefabricated works, specified by Koster Fine Art.Statutory right of cancellation & sample cancellation form:

You have the right to cancel this contract without reason within 14 days. The cancellation policy lasts 14 days from:
The day on which you – or a third party named by you who is not the shipping service – take/takes the goods into possession, if you ordered one item or multiple items in a single order, and the item(s) arrive(s) in a single delivery.

To exercise your right to cancel, you must inform us Koster Fine Art, Meentweg 12, 1411GS Naarden. e-mail : info@kosterfineart.com of your decision to cancel in a clear, written statement (by letter or e-mail, for instance). You may use the cancellation form we've provided, but are not required to do so:
The deadline for the right to cancel will be met as long as your statement indicating you will be exercising the right to cancel is sent within the allotted cancellation period.
Cancellation Terms and Process
Should you cancel the sale contract, we are to refund all payments received from you, excluding shipping costs, promptly - at the latest, within 30 days of our receipt of the statement indicating your cancellation. Refunds will be credited back to the original payment method, unless otherwise expressly agreed upon. We can withhold the refund until such time as we have received the returned goods or until you have provided proof of their return shipment, whichever comes first. You are to send the goods back in the original packaging without delay. At the very latest, they must be sent within 30 days of the day you inform us of the cancellation. This deadline is met as long as the return shipment is sent within the allotted 30 days.
You shall bear the direct cost of return shipping for your order. Goods cannot be returned by normal post.
You are only responsible for decreases in the value of goods if, after inspecting their condition, properties, and functionality, the decrease in value can be traced back to your improper handling of the goods.
Delivery
Unless agreed otherwise, delivery will be ex print or frameshop to your address or to the delivery address specified by you and because your order is especialy made to your wishes, production and delivery time is approx. 14 workdays. Don't accept any shipment when the package is torn, bended or looks damaged.
Edition Certificate with signature
For organisational reasons, Koster Fine Art may also send the orderer the Edition Certificate with the artist’s signature and the edition details separately – and subject to a delay. In this case, the cancellation period shall only start after receipt of the Editions Certificate with signature. If you exercise your right of cancellation, you must also immediately return the unused Edition Certificate. The purchase price shall not be refunded without receipt of Edition Certificate. The right of cancellation shall lapse if the Edition Certificate is used on the work of art, the frame, the lamination or elsewhere.
Prices, due date and payment, default
The prices stated in the online shop are final prices including sales taxes. Shipping costs are not included in the price and are added to it in each case. Information about the shipping costs is contained in Section 7 of these Terms and Conditions.
The purchase price is paid via credit card (Visa, Mastercard, American Express).
Should the account of the orderer lack sufficient funds, or the orderer countermand the bank debit without just reason, Koster Fine Art shall have the right to demand an administration fee of €10.00 from the orderer.
Invoices must be paid within 10 days of the invoice date.
If you are in default, Koster Fine Art reserves the right to charge consumers default interest at 5 percentage points above the respective base rate per annum published by the European Central Bank and to charge companies 9 percentage points above the respective base rate per annum published by the European Central Bank. In addition, Koster Fine Art can charge a flat rate of €2.50 per reminder, except for the initial reminder. Where greater costs are demonstrably incurred as a result of these payment arrears, Koster Fine Art reserves the right to assert claims in respect of these.
In the above cases you are entitled to prove that no costs were in fact incurred by Koster Fine Art or that these costs were less than the flat-rate fees stated above.
Shipping costs
For deliveries inside the Netherlands, Koster Fine Art applies the shipping rates of Post NL, which include our secure specialty packaging and insurance:

Orders with items of different sizes will be shipped at the rate of the largest picture in the order.
Offsetting, retention
You only have the right to offset if your counterclaims are legally upheld or are acknowledged by Koster Fine Art. You also have the right to offset if you complain of defects or assert counterclaims under the same purchase contract. In addition, you are only authorised to exercise the right of retention to the extent that your counterclaim is based on the same contractual relationship.
Retention of title
Until full and final payment, the delivered goods shall remain the property of the artist or Koster Fine Art Gallery.
Liability
Within the scope of statutory provisiois liable for damages without restriction.
Relating to loss of life, physical injury or damage to health which is due to wilful or negligent breach of duty or is otherwise due to wilful or negligent conduct by Koster Fine Art.
Which is due to wilful or negligent breach of duty or is otherwise due to wilful or grossly negligent conduct by the provider.
The liability of Koster Fine Art shall be limited to compensation for foreseeable loss or damage typical for the contract caused due to slightly negligent breaches of material duties by Koster Fine Art. Material duties are duties whose fulfilment is a prerequisite for proper implementation of the contract and whose observance the orderer may rely on.
The above provisions shall apply accordingly to the liability of Koster Fine Art in respect of reimbursing futile costs. Liability under the Product Liability Act shall remain unaffected.
Warranty
Unless expressly agreed otherwise, statutory warranty rights shall apply. The statutory warranty period of one year shall apply. This shall start upon handover of the goods. During this period, all defects subject to statutory warranty obligations shall be corrected free of charge.
If a defect is discovered during the inspection or subsequently, we must be advised of this immediately. Immediate in this case is if you advise us within two weeks, with the timely sending of the notification being sufficient for meeting the deadline. Irrespective of this duty of inspection and complaint, you must report obvious defects (including incorrect or short deliveries) in writing within two weeks of delivery, with the timely sending of the notification being sufficient for meeting the deadline. If you fail to perform a proper inspect and/or notify us of the defect, our liability for the unreported defect is excluded.
No granting of rights
By buying a photographic print, you are only acquiring material ownership of the print. No other rights are granted or implied. Any reproduction (copying), dissemination, leasing, public exhibition or other analogue or digital use is not permitted unless authorised by law. However, you can resell the print.
Collecting, processing and using personal data

Applicable law
Dutch law shall apply. This document is a translation. In the event of any dispute to the interpretation of any of these conditions, the official Dutch language version shall prevail.
